Terms of Service – Spēek

These Terms of Service ("Terms") govern your use of the Spēek language learning app ("the App") and related services. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Acceptance and the Privacy Policy

By using the App, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy, which describes how we collect, use, and protect your personal data.

2. Eligibility

You must be at least 13 years of age (or the minimum age in your jurisdiction to use such services) to use the App. By using the App, you represent that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organisation, you represent that you have authority to bind that organisation.

3. Account

• You may sign in using Sign in with Apple. You are responsible for keeping your Apple ID secure and for all activity that occurs under your account.
• You must provide accurate information and must not impersonate others or create multiple accounts to abuse the service.
• We may suspend or terminate your account if you breach these Terms or for other reasons we consider necessary for the security or operation of the service.

4. Use of the App

• You may use the App only for personal, non-commercial language learning in accordance with these Terms and any in-app guidelines.
• You must not: copy, modify, reverse engineer, or attempt to extract the source code of the App (except as permitted by applicable law); use the App for any illegal or unauthorised purpose, or in a way that infringes the rights of others; abuse, harass, or harm others, or use the App to distribute malware or spam; circumvent any access controls, payment systems, or security measures.

We may update the App from time to time; continued use after updates constitutes acceptance of the updated App and these Terms where applicable.

5. Purchases and refunds

• The App may offer in-app purchases (e.g. "Unlock All" for a language or individual levels). All purchases are processed by Apple. Payment and billing are subject to Apple’s terms and conditions.
• Refunds: Refund requests for in-app purchases must be made through Apple (e.g. via Report a Problem in your Apple ID account). We do not process refunds directly.
• Purchases typically grant you a non-exclusive, non-transferable licence to access the purchased content for your personal use in the App, subject to these Terms. We do not guarantee that purchased content will be available indefinitely; we will use reasonable efforts to maintain access.
• Account deletion and purchases: If you delete your account, we remove our records of your account and any purchase records we hold (e.g. which levels or languages you unlocked). The entitlement to previously purchased content remains with your Apple ID; Apple continues to hold the transaction. If you later sign in again with the same Apple ID and use "Restore purchases" in the App, we may restore your access to that content in line with Apple’s and our app’s behaviour. We do not guarantee that restored access will be available in all circumstances.

6. Intellectual property

The App, including its design, text, graphics, lessons, and software, is owned by SPĒEK or its licensors. You receive only a limited, non-exclusive, revocable licence to use the App for your personal use in accordance with these Terms. You do not acquire any ownership or rights in the App or its content.

7. Disclaimer of warranties

The App and content are provided "as is" and "as available" without warranties of any kind, either express or implied (including implied warranties of merchantability, fitness for a particular purpose, or non-infringement). We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Your use of the App is at your own risk.

8. Limitation of liability

To the maximum extent permitted by applicable law:

• SPĒEK and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, profits, or goodwill) arising from your use of or inability to use the App.
• Our total liability for any claims arising out of or related to these Terms or the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim (or, if no payment, fifty pounds sterling or the equivalent in local currency).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (e.g. for death or personal injury caused by negligence, or fraud).

9. Termination

• You may stop using the App at any time. You may also delete your account from within the App (Account → Delete account) or by contacting us; see our Privacy Policy for how we handle account deletion and data.
• We may suspend or terminate your access to the App or your account if you breach these Terms or for operational, legal, or security reasons. Where reasonably possible, we will give you advance notice.
• On termination, your right to use the App ceases. Provisions that by their nature should survive (including disclaimers, limitation of liability, and governing law) will survive termination.

10. Governing law and disputes

These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms or the App shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer law in your country requires otherwise.

11. Changes to the Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and/or by email if we have your contact details. The "Last updated" date at the top indicates when the Terms were last revised. If you continue to use the App after the changes take effect, you agree to the updated Terms. If you do not agree, you must stop using the App and may delete your account.
