Privacy Policy – Spēek

This privacy policy explains how we collect, use, and protect your information when you use the Spēek language learning app ("the App").

1. Who we are

The data controller responsible for your personal data is:

SPĒEK is currently operated as a sole trader business in the United Kingdom.

2. What data we collect

We collect and process the following data in connection with the App:

  • Account data: When you sign in with Apple, we receive an identifier from Apple and, if you choose to share it, your email address. We may also store the name you provide via Apple on first sign-in (used only to personalise the app experience and analytics).
  • Progress and sync data: Lesson progress (e.g. which lessons you have started or completed, scores) so we can sync your progress across devices and restore it when you reinstall the app.
  • Device data: Device identifiers and device names so we can associate your account with the devices you use and support multi-device sync.
  • Purchase records: Records of in-app purchases (e.g. "Unlock All" or level purchases) to grant and restore access. Purchase transactions are processed by Apple; we store only the fact that you have purchased a product for a given language/level.
  • Voice / audio: The App uses the microphone and speech recognition to transcribe what you say during lessons. Audio may be processed on your device and/or sent to our servers (or third-party speech services) solely to provide the lesson experience. We do not use your voice for marketing or unrelated purposes.
  • Analytics: We use analytics (including Mixpanel) to understand how the App is used (e.g. which screens are viewed, lesson completion). We also store certain learning-related events (e.g. incorrect answers) on our servers for up to one year to improve the product; this data may be linked to your account or device.

3. Why we use your data

We use your data for the following purposes and legal bases (where applicable under GDPR):

  • Performance of contract: To create and manage your account, sync your progress, register your devices, and fulfil your in-app purchases.
  • Legitimate interests: To operate, secure, and improve the App, including limited product analytics (such as screen views and lesson completion), fixing bugs, and understanding usage patterns. We minimise data collected for analytics, avoid unnecessary identifiers, and retain analytics data for no longer than necessary. We have assessed that this processing is proportionate and does not override your rights and freedoms.
  • Consent: Where we ask for your consent (e.g. for optional marketing or non-essential analytics), you may withdraw it at any time without affecting the core service.

4. Automated decision-making

The App uses automated processing technologies, such as speech recognition and automated scoring of exercises, to deliver lessons and provide feedback. These systems analyse audio and text inputs to generate educational responses.

We do not make decisions that produce legal effects or similarly significant effects about you based solely on automated processing.

5. Who we share your data with

We share data only as necessary with:

  • Apple: For Sign in with Apple and in-app purchase processing. Apple’s privacy policy applies to those services.
  • Amazon Web Services (AWS): Our backend and data storage are hosted on AWS (e.g. in the EU). AWS acts as a processor on our instructions.
  • Mixpanel: We use Mixpanel for product analytics. Mixpanel may process data as a processor or independent controller; see Mixpanel’s privacy policy for details.
  • Speech / AI services: If we use third-party services for speech recognition or text-to-speech, we may send audio or text to those providers only to deliver the lesson experience. We do not use them for advertising or unrelated purposes.

We do not sell your personal data.

6. International transfers

Your data may be transferred to and processed in countries outside your country of residence, including the United States (e.g. Mixpanel, some AWS regions). Where required by law, we ensure appropriate safeguards (such as standard contractual clauses approved by the European Commission) are in place for such transfers.

7. How long we keep your data

  • Account and progress: We keep your account and progress data until you delete your account (see "Your rights" below).
  • Purchase records: Retained as long as your account exists, and as required for tax/legal compliance where applicable.
  • Analytics / incorrect answers: Retained for up to one year, then deleted or anonymised.
  • Device data: Removed when you remove a device from your account or when you delete your account.

8. Your rights (including GDPR)

If you are in the UK or the European Economic Area, you have the right to:

  • Access: Request a copy of the personal data we hold about you.
  • Rectification: Request correction of inaccurate or incomplete data.
  • Erasure: Request deletion of your data, including your account ("right to be forgotten"). You can delete your account from within the App (Account → Delete account) or by contacting us.
  • Portability: Request a copy of your data in a structured, machine-readable format where technically feasible.
  • Object: Object to processing based on legitimate interests (including certain analytics).
  • Restrict: Request that we restrict processing in certain circumstances.
  • Withdraw consent: Where we rely on consent, you may withdraw it at any time.
  • Complain: Lodge a complaint with a supervisory authority (e.g. the ICO in the UK or your local data protection authority).

To exercise any of these rights, contact us at help@spēek.com. We will respond within the time required by applicable law (e.g. one month under GDPR).

9. Security

We use appropriate technical and organisational measures (including encryption, access controls, and secure hosting) to protect your data against unauthorised access, loss, or misuse.

10. Children

The App is not directed at children under 13 years of age.

If you are located in the United Kingdom, you must be at least 13 to use the App without parental consent. If you are located in the European Economic Area, you must be at least 16 (or the applicable age of digital consent in your country) unless parental consent has been obtained.

We do not knowingly collect personal data from children below the applicable age. If you believe we have collected such data, please contact us and we will delete it.

11. Changes to this policy

We may update this privacy policy from time to time. We will notify you of material changes by posting the updated policy in the App and/or by email if we have your email address. The "Last updated" date at the top indicates when the policy was last revised. Where required by law, we will seek your consent to material changes. Otherwise, continued use of the App after updates take effect constitutes acceptance of the revised policy.
